Terms of Service

Please read these terms carefully before using SaveMyTracks. By accessing our service, you agree to be bound by these terms and all applicable laws.

Agreement to Terms: By using SaveMyTracks, you confirm you have read, understood, and agree to these Terms of Service. If you do not agree, you must immediately stop using the Service. These terms apply to all visitors and users of savemytracks.com.

Acceptance of Terms

These Terms of Service ("Terms," "Agreement") constitute a legally binding agreement between you ("User," "you," or "your") and SaveMyTracks ("we," "us," "our," or the "Company"), the operator of savemytracks.com (the "Website") and all related services (collectively, the "Service").

By accessing or using the Service in any manner, including browsing the Website, submitting a URL for conversion, or downloading any file, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

If you are accessing the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, in which case "you" refers to both you individually and that organization.

Important: SaveMyTracks is an independent service and is not affiliated with, endorsed by, licensed by, or in any way officially connected to Spotify AB, Apple Inc., or any other music streaming platform. Use of third-party trademarks on this site is solely for descriptive purposes and does not imply any association.

Description of Service

SaveMyTracks provides a web-based tool that allows users to convert and download audio content associated with Spotify track URLs into MP3 and other audio formats for personal, offline playback (the "Service"). The Service is provided free of charge, without requiring user registration or account creation.

2.1 What the Service Provides

  • Conversion of publicly accessible Spotify track links into downloadable audio files
  • Audio output in MP3 format at up to 320kbps quality
  • Temporary file hosting for a limited period to facilitate user downloads
  • A browser-based interface requiring no software installation

2.2 Service Availability

We strive to maintain high availability but do not guarantee that the Service will be available at all times. The Service may be subject to downtime for maintenance, updates, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without notice or liability.

Eligibility

To use the Service, you must meet the following eligibility requirements. By using the Service, you represent and warrant that:

  • You are at least 13 years of age (or 16 years of age in the European Union/EEA). If you are under the applicable age of majority in your jurisdiction, you must have your parent's or guardian's permission to use the Service.
  • You have the legal right and capacity to enter into a binding agreement and are not barred from receiving services under applicable law.
  • You are not located in a country that is subject to an embargo by your government, or that has been designated as a "terrorist supporting" country.
  • You will use the Service solely for lawful purposes and in a manner that complies with all applicable local, national, and international laws and regulations.
  • Your use of the Service does not violate any obligation you may have to a third party, such as a contractual obligation of confidentiality.

Minors: The Service is not directed to children under 13. If we become aware a minor under 13 has used the Service, we will take steps to restrict further access. Parents and guardians are responsible for supervising their children's internet use.

Permitted Use

Subject to your full compliance with these Terms, SaveMyTracks grants you a limited, non-exclusive, non-transferable, revocable license to use the Service solely for lawful personal purposes as expressly permitted below.

4.1 Authorized Uses

  • Personal Offline Listening: Downloading audio files for your own private, non-commercial offline playback on your personal devices.
  • Backup of Owned Content: Creating personal backup copies of music you have legally purchased or have the right to access, consistent with applicable fair use or private copying laws in your jurisdiction.
  • Accessibility: Converting content to formats accessible on your personal devices for personal use in areas with limited or no internet connectivity.

4.2 Your Responsibilities

You are solely responsible for ensuring that your use of the Service and any downloaded content complies with:

  • All applicable copyright, intellectual property, and related laws in your country of residence
  • The Terms of Service of Spotify AB and any other platform whose content you submit through the Service
  • Any licensing agreements or digital rights management (DRM) terms associated with the content you download

Note on Fair Use / Private Copying: Laws regarding personal copying of copyrighted audio vary significantly by jurisdiction. In some countries, private copying for personal use is permitted under a "fair use" or "private copying" exception. In others, it may be prohibited regardless of intent. It is your responsibility to understand the laws of your jurisdiction before using this Service.

Prohibited Conduct

You agree that you will NOT use the Service in any of the following ways. Violations may result in immediate termination of your access and may expose you to civil and/or criminal liability.

5.1 Copyright & Distribution Violations

  • Redistributing, reselling, sublicensing, broadcasting, or publicly performing any downloaded audio content without authorization from the rights holder
  • Uploading downloaded files to streaming platforms, file-sharing services, torrent networks, or any public-facing media
  • Using downloaded content as background music in commercial video productions, advertisements, podcasts, or any monetized media without proper licensing
  • Creating derivative works from downloaded audio for commercial purposes without authorization

5.2 Technical Abuse

  • Using automated scripts, bots, crawlers, scrapers, or any non-human means to access or interact with the Service without our prior written consent
  • Attempting to reverse engineer, decompile, disassemble, or otherwise derive the source code of the Service
  • Circumventing, bypassing, or disabling any rate limiting, security feature, or access control measure implemented by the Service
  • Sending excessive requests that place an unreasonable or disproportionately large load on our infrastructure
  • Attempting to gain unauthorized access to any system, server, database, or account connected to the Service
  • Transmitting viruses, malware, spyware, or any other harmful or destructive code through the Service

5.3 Unlawful & Harmful Use

  • Using the Service for any purpose that is unlawful, fraudulent, or harmful, or in connection with any unlawful, fraudulent, or harmful purpose or activity
  • Using the Service to infringe upon the intellectual property rights, privacy rights, or any other rights of any third party
  • Impersonating SaveMyTracks or creating a service that substantially replicates or competes with the Service using our infrastructure
  • Using the Service in a manner that violates Spotify's Terms of Service or any other third-party platform agreement
  • Building a commercial product or service that wraps, embeds, or resells access to the Service without our prior written authorization

Enforcement: We actively monitor for abuse patterns including automated scraping, excessive download volumes, and known distribution networks. Violations will result in permanent IP-level blocking and may be reported to relevant authorities or rights holders.

Intellectual Property

6.1 Our Intellectual Property

The Service, including its design, layout, user interface, source code, software, graphics, logos, text, and all other content created by SaveMyTracks (collectively, "Our Content"), is protected by applicable intellectual property laws, including copyright and trademark law.

You are granted no right or license in Our Content except the limited right to use the Service as expressly described in these Terms. You may not copy, reproduce, distribute, transmit, display, modify, create derivative works from, or otherwise exploit Our Content without our prior written consent.

6.2 Third-Party Content & Trademarks

All audio content accessible through the Service is owned by the respective artists, record labels, publishers, and rights holders. SaveMyTracks does not claim ownership of any audio content processed through the Service.

References to "Spotify," the Spotify logo, and related marks are trademarks of Spotify AB. "SaveMyTracks" is not affiliated with Spotify AB in any way. These references are used descriptively only to indicate compatibility and do not constitute any endorsement or partnership.

6.3 Feedback

If you provide us with any suggestions, feedback, ideas, or recommendations regarding the Service ("Feedback"), you grant SaveMyTracks a perpetual, irrevocable, royalty-free, worldwide license to use, incorporate, and exploit such Feedback in any manner, without any obligation, compensation, or restriction.

DMCA & Copyright Infringement

SaveMyTracks respects the intellectual property rights of others and expects users of the Service to do the same. We comply with the provisions of the Digital Millennium Copyright Act (DMCA).

7.1 Reporting Infringement

If you are a copyright owner or authorized representative and believe that any content processed or served by the Service infringes your copyright, you may submit a written DMCA takedown notice to our designated contact at [email protected]. Your notice must include all of the following:

  • A physical or electronic signature of the person authorized to act on behalf of the owner of the copyright interest
  • A description of the copyrighted work you claim has been infringed, including the title, artist, and any relevant registration information
  • The specific URL or description of the material on our Service that you claim is infringing
  • Your contact information: name, postal address, telephone number, and email address
  • A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law
  • A statement made under penalty of perjury that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf

7.2 Counter-Notices

If you believe that material was removed or access to it was disabled as a result of a mistake or misidentification, you may submit a counter-notice to [email protected]. A valid counter-notice must include: your name, address, and electronic or physical signature; identification of the material removed; a statement under penalty of perjury that you have a good-faith belief that the material was removed by mistake; and your consent to jurisdiction of the applicable federal court.

7.3 Repeat Infringer Policy

It is our policy to terminate access to the Service for users who are determined to be repeat infringers of copyright. We reserve the right to block IP addresses, networks, or access patterns associated with repeated or flagrant copyright violations.

8.1 "As Is" Service

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SAVEMYTRACKS EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • Implied Warranties: All implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
  • Accuracy: Any warranty that the Service will be accurate, complete, reliable, current, or error-free.
  • Continuity: Any warranty that the Service will be available on an uninterrupted, timely, or secure basis.
  • Quality: Any warranty regarding the quality, fidelity, or completeness of downloaded audio files.
  • Virus-Free: Any warranty that the Service or any content is free of viruses, malware, or other harmful components.

8.2 No Affiliation Disclaimer

SaveMyTracks is not endorsed by, affiliated with, authorized by, or in any way officially connected to Spotify AB, Apple Inc., YouTube, SoundCloud, or any other music streaming service. All product names, logos, and brands are the property of their respective owners and are used for descriptive purposes only.

8.3 Legal Compliance Disclaimer

SaveMyTracks makes no representations or warranties regarding the legality of downloading music in your jurisdiction. You are solely responsible for determining whether your use of the Service complies with applicable laws in your country. We strongly encourage you to seek independent legal advice if you are uncertain about your legal rights.

User Responsibility: Your use of this Service is entirely at your own risk. SaveMyTracks accepts no responsibility for consequences arising from your use of downloaded content, including but not limited to legal claims by rights holders, account suspension by third-party platforms, or any direct or indirect damages.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SAVEMYTRACKS, ITS OPERATORS, AFFILIATES, LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR ANY:

  • Indirect Damages: Indirect, incidental, special, consequential, or punitive damages of any kind.
  • Lost Profits or Data: Loss of profits, revenue, data, business, goodwill, or anticipated savings.
  • Costs of Substitution: Cost of procurement of substitute goods or services.
  • Legal Consequences: Any claims arising from copyright infringement, unauthorized distribution, or violation of third-party terms of service by you.
  • Service Interruptions: Any loss or damage arising from downtime, service interruption, data loss, or unauthorized access to servers.

These limitations apply regardless of whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, and even if SaveMyTracks has been advised of the possibility of such damages.

In jurisdictions that do not allow the exclusion or limitation of incidental or consequential damages, the above limitations may not fully apply to you. In such cases, our total liability to you for all damages arising under these Terms shall be limited to the greater of (a) the amount you paid to use the Service in the twelve (12) months preceding the claim, or (b) USD $10.00.

Indemnification

You agree to defend, indemnify, and hold harmless SaveMyTracks, its operators, affiliates, licensors, and their respective officers, directors, employees, contractors, and agents (collectively, the "Indemnified Parties") from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or relating to:

  • Your access to or use of the Service in violation of these Terms
  • Your violation of any applicable law, regulation, or third-party right, including any intellectual property, privacy, or publicity right
  • Your unauthorized distribution, resale, or commercial exploitation of content downloaded through the Service
  • Any claim by a third party (including rights holders and their representatives) arising from your use of downloaded content
  • Your violation of the Terms of Service of Spotify AB or any other third-party platform
  • Any content or information you submit, post, or transmit through the Service

SaveMyTracks reserves the right to assume exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate fully with us in asserting any available defenses. You agree not to settle any such claim without our prior written consent.

The Service may contain links to third-party websites, services, or resources that are not owned or controlled by SaveMyTracks. These links are provided solely for your convenience and informational purposes.

  • SaveMyTracks has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services.
  • We do not endorse or make any representations about third-party websites, services, or resources.
  • You acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with your use of any third-party content, goods, or services.
  • We strongly advise you to read the terms and privacy policies of any third-party websites you visit.

The Service may incorporate or utilize third-party APIs and data sources. The availability and functionality of the Service may be affected by changes to these third-party services, and we disclaim all liability for any resulting disruption to the Service.

Termination & Suspension

SaveMyTracks reserves the right, at its sole discretion, to restrict, suspend, or permanently terminate your access to the Service at any time and for any reason, including but not limited to:

  • Violation of any provision of these Terms
  • Conduct that we determine, in our sole judgment, is harmful to other users, third parties, or the Service
  • Repeated receipt of valid DMCA takedown notices related to your usage
  • Suspected automated, abusive, or fraudulent use of the Service
  • Requests from law enforcement or other government agencies
  • Discontinuation of the Service or a material change in the nature of the Service

We may also block IP addresses, geographic regions, or networks at our discretion and without notice. Termination of your access shall not limit any of our other rights or remedies at law or in equity.

12.1 Effect of Termination

Upon termination: (a) all rights and licenses granted to you under these Terms will immediately cease; (b) you must immediately stop using the Service; and (c) provisions of these Terms that by their nature should survive termination — including but not limited to ownership, warranty disclaimers, indemnification, and limitations of liability — will remain in full force and effect.

Governing Law & Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with applicable international law. Where a specific jurisdiction must be identified for legal proceedings, the parties agree to submit to the jurisdiction of competent courts. Nothing in this clause limits SaveMyTracks's ability to seek injunctive or other equitable relief in any jurisdiction.

13.2 Informal Resolution

Before filing any formal legal claim, you agree to attempt to resolve any dispute informally by contacting us at [email protected]. We will make good-faith efforts to resolve the dispute within 30 days of receiving your written notice. If the dispute is not resolved within that period, either party may pursue formal legal remedies.

13.3 Waiver of Class Action

To the maximum extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive your right to participate in a class action lawsuit or class-wide arbitration.

13.4 Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will continue in full force and effect.

Changes to These Terms

SaveMyTracks reserves the right to modify these Terms at any time. Changes become effective upon posting to this page. We will notify users of material changes by:

  • Updating the "Last Updated" date at the top of this page
  • Displaying a prominent notice on the Website for at least 30 days following the change

Your continued use of the Service after the effective date of any amended Terms constitutes your binding acceptance of those changes. If you do not agree with the updated Terms, you must immediately stop using the Service.

Entire Agreement: These Terms, together with our Privacy Policy and any other legal notices or policies published on the Service, constitute the entire agreement between you and SaveMyTracks with respect to your use of the Service and supersede all prior and contemporaneous agreements, representations, and understandings.
